Estate Planning Services
An estate plan may include the following types of legal documents:
- Will: A legal will tells your family and the probate court who should receive your property when you die. If you have minor children, your will can also name a guardian and trustee for them if both you and your spouse die before they reach age 18.
- Trust: In many states, trusts are a favored tool in estate planning to avoid probate. In some states, trusts will save your beneficiaries a great deal of time and money. However, Colorado probate is not a difficult or expensive process. Unless you have significant assets, a trust may not be needed.
- Power of attorney: A power of attorney allows you to name a trusted person to handle your financial affairs if you become incapacitated. You may assume that your spouse could step into your shoes, but that is not necessarily the case. Without a power of attorney, your family may have to go through the time and expense of a guardianship or conservatorship proceeding to act on your behalf.
- Medical power of attorney: A medical power of attorney allows you to name a trusted person to handle your medical care if you are incapacitated and cannot communicate for yourself.
- Living will and medical power of attorney: A living will allows you to tell your family members and medical professionals whether you want feeding tubes and other artificial care if you are in an end-of-life condition with no hope of recovery.
