Boulder Estate Planning Attorneys

Boulder and Longmont Probate Lawyers

Many people think that estate planning is only for the elderly or the wealthy. However, everyone needs a basic estate plan to protect their family members from potential disputes and unnecessary expenses in the event of death or incapacity.

At Warren, Carlson & Moore, LLP, our lawyers create estate plans for families of all income and asset levels. We also represent personal representatives (executors) and beneficiaries in Colorado probate proceedings and probate litigation. From our law office in Niwot, we represent clients in Boulder and Longmont and throughout the Front Range of Colorado.

Estate Planning Services

An estate plan may include the following types of legal documents:

  • Will: A legal will tells your family and the probate court who should receive your property when you die. If you have minor children, your will can also name a guardian and trustee for them if both you and your spouse die before they reach age 18.
  • Trust: In many states, trusts are a favored tool in estate planning to avoid probate. In some states, trusts will save your beneficiaries a great deal of time and money. However, Colorado probate is not a difficult or expensive process. Unless you have significant assets, a trust may not be needed.
  • Power of attorney: A power of attorney allows you to name a trusted person to handle your financial affairs if you become incapacitated. You may assume that your spouse could step into your shoes, but that is not necessarily the case. Without a power of attorney, your family may have to go through the time and expense of a guardianship or conservatorship proceeding to act on your behalf.
  • Medical power of attorney: A medical power of attorney allows you to name a trusted person to handle your medical care if you are incapacitated and cannot communicate for yourself.
  • Living will and medical power of attorney: A living will allows you to tell your family members and medical professionals whether you want feeding tubes and other artificial care if you are in an end-of-life condition with no hope of recovery.

Our lawyers also handle elder law issues such as Medicaid planning.
